Terms of Service for Problembo

1. General Provisions

1.1. The Problembo service administration (the "Contractor") offers Internet users (each a "User") the use of the "Problembo" service available at https://problembo.com, through the Telegram bot, and through the Client API (the "Service").

1.2. By using the Service, the User accepts these Terms, the Offer, and the Privacy Policy in full, without any reservations or exceptions. A User who does not agree with any provision of these documents may not use the Service.

1.3. The Contractor may amend these Terms without special notice. A new version takes effect when it is published, unless the version itself provides otherwise. The current version is always available at https://problembo.com/docs/legal/terms-of-use. A User who does not agree with the changes must stop using the Service.

1.4. These Terms are published in Russian and English. If the texts differ, the Russian version prevails.

2. Use of the Service

2.1. The Service lets Users create and process images, videos, texts, audio, and other materials using artificial intelligence and other tools, based on the User's prompts and files ("Materials"). Text prompts, parameters, and uploaded files are referred to as "Requests".

2.2. The full functionality of the Service is available to Users who are signed in and use the Paid Balance. Users can sign in with a Problembo, Google, Microsoft, or GitHub account.

2.3. A signed-in User gets a personal account with Personal Account Balance information and task history. The User can clear the task history and delete the account in the profile.

2.4. A User who uses the Bonus Balance may not have more than one account on the same device.

2.5. The User may not circumvent the Service's limits, including by increasing the number of free generations or bypassing age restrictions and automated moderation, whether manually or by automated means.

3. Adult Content

3.1. The Service is not intended for persons under 16. Certain models and features that can produce sexually explicit or adult content are marked "18+" and are available only to adult Users (18 or older, or the higher age of majority in the User's country, if any).

3.2. To access "18+" features, the User provides a year of birth and confirms that it is accurate. Providing false information is a serious breach of these Terms and grounds for blocking the account.

3.3. The User uses "18+" features only in countries where receiving and storing such content is lawful.

3.4. When using the Client API, the User is responsible for ensuring that "18+" content is requested only by adults and for its end users' compliance with these Terms.

4. Prohibited Content

4.1. Users may not use in Requests, create, store with the Service, or distribute Materials that:

• depict minors or persons who appear to be minors in a sexual or explicit context, including drawn, animated, and generated images, regardless of the character's stated age;
• depict a real person nude or in a sexual or intimate context without that person's explicit prior consent, including by "undressing", face swapping, or otherwise processing their photos or videos;
• present a generated image, video, or voice of a real person as authentic in order to deceive, defraud, blackmail, harass, discredit, or interfere with elections;
• are illegal in the User's country or prohibited from distribution by applicable law;
• contain defamation or insults, incite ethnic hatred, or promote hatred or discrimination based on race, ethnicity, gender, religion, social status, or other characteristics;
• realistically depict sexual violence, or contain shocking scenes of violence and cruelty, including murder, mutilation, torture, self-harm and suicide, and animal cruelty;
• contain instructions for making weapons or explosives, or for producing or using drugs;
• infringe copyrights, trademarks, or other intellectual property of third parties.

4.2. By uploading a photo, video, or voice recording of a real person, the User warrants that the User is that person or has obtained that person's consent to such processing and to the further use of the result. The User is responsible for any lack of consent.

4.3. The Contractor may review Requests and Materials automatically and manually, including through third-party moderation services, and may refuse to perform a task without giving reasons. A refusal does not mean that other Requests are permitted.

5. Content Complaints

5.1. Anyone, including persons who are not Users, may report Materials that violate the law or their rights, in particular intimate images created without consent and materials involving minors, at support@problembo.com.

5.2. A complaint should describe the violation and, where possible, include a link to the material, the task ID, or a copy of the material, together with a contact for a reply. A person depicted in a material may request its removal without giving reasons.

5.3. The Contractor handles complaints as a priority. If a violation is confirmed, the Contractor removes the Materials concerned and may restrict the User's access to the Service or block the User's account.

5.4. The Contractor reports sexual materials involving minors to the competent authorities and retains the information needed for an investigation to the extent permitted by law.

6. Rights to the Service and Materials

6.1. All rights to the Service, including software, design, and their individual elements, belong to the Contractor or its licensors.

6.2. The User may use Materials the User has created for personal non-commercial purposes in compliance with these Terms and applicable law. Commercial use is permitted under Section 2.10 of the Offer.

6.3. The User may not circumvent the Service's technical protection measures or copy, reproduce, modify, or distribute elements of the Service beyond the capabilities the Service provides.

7. Liability and Limitations

7.1. The User is fully responsible for the User's Requests, uploaded files, and created Materials, and for their use and distribution.

7.2. The Contractor may, at its discretion, restrict the User's access to the Service or its individual features, or block the account, if the User breaches these Terms or the other documents listed in clause 1.2, and may take other measures needed to comply with the law or protect the rights of third parties.

7.3. The Service does not guarantee that results will meet the User's goals and expectations or that it will operate without interruptions or errors. The Contractor may change the Service's functionality in whole or in part at any time.

7.4. The Contractor is not responsible for the content of Materials created by Users or for the accuracy and correctness of information obtained through the Service. The content of Materials does not represent the Contractor's position.

7.5. The User's personal data is processed in accordance with the Privacy Policy.

8. Deletion of Inactive Accounts

8.1. The Contractor may delete the User's account without prior notice if all of the following conditions are met at the same time:

• the account was created more than 500 days ago;
• during the last 500 days the User has not created tasks paid from the Personal Account Balance, including the Bonus Balance, has not topped up the balance, and has not made other payments or charges from the Personal Account Balance; signing in to the account alone is not considered activity;
• the Paid Balance is less than $1;
• the User has no active or unfinished paid services, unfinished payments, or funds reserved for tasks in progress.

8.2. When the account is deleted, the remaining Paid Balance (less than $1) and the entire Bonus Balance are cancelled and are not refunded or compensated.

8.3. Deletion removes the account, the profile, API tokens, and linked Telegram and chat accounts, and ends access to the Service through this account. Task history, files, and trained models linked to the account become permanently unavailable. Records of payments and charges may be retained to the extent required for accounting, reconciliation with payment providers, and compliance with the law.

8.4. A deleted account cannot be restored. The User may register again with the same email address, but the new account will not have access to the data of the deleted account.
